You need to know the Rules!
The drawing for the Fender Museum of Music and the Arts (FMMA) ROCK THE HOUSE (House) will be held on October 10, 2004, at 5:00pm PDT. Ticket sales will cease at 4:30pm PDT on the day of the drawing. Tickets may sell out prior to such time. The certified public accounting and consulting firm of Vavrinek, Trine, Day & Co. LLP will oversee and supervise the drawing. The drawing will be held at the Fender Museum, 365 N. Main St., Corona, CA 92880. Though the drawing will be open to the public, you do not have to be present to win. Total attendance at the drawing may be limited by FMMA as required by local law.

The chances of winning any prize, and the amount or value of all prizes will be determined by the number of tickets sold, which will not exceed 10,000. The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions.

Each winner assumes all fees, local, state, and federal taxes, and financing costs (including but not limited to, closing costs and title insurance). This offer is void where prohibited by law. By entering this raffle, entrants accept and agree (i) to be bound by these rules, limitations and restrictions and by the decisions of the FMMA, and (ii) that their names and/or likenesses may be disclosed to and used by the news media and may otherwise be used, free of charge, for publicity purposes by FMMA. All participants need to know this…
If fewer than 1,500 tickets are sold by 4:30pm PDT on the day of the drawing, the raffle will be canceled and the funds received will be considered charitable donations and the funds used directly to pay all costs incurred and the balance to support the Kids Rock Free® program. Each ticket holder will receive a receipt of donation for tax purposes and presented with a Scholarship Contribution Certificate. Should this occur, $100 per ticket will qualify as a tax deductible charitable contribution ($50 of the ticket price receives a Gold Membership and, thus, does not qualify for deduction).

For all prizes for which there is a cash alternative option, the winner must make an election in writing between the prize and the cash before 5:00pm PDT on May 30, 2004. If any winner fails to make an election by this deadline, he or she will be deemed to have elected the cash option.

If you’re the Grand Prize winner, you’ll need to know this...
A maximum number of 10,000 tickets will be sold. A minimum of 7,000 must be sold for the Grand Prize winner to have a choice of the House or the alternate cash prize of $300,000. If fewer than 7,000 tickets, but more than 1,500 tickets, are sold by 4:30pm PDT on the day of the drawing, the raffle will be held as scheduled, and all prizes will be awarded as advertised with the exception that the Grand Prize winner will receive a share of the net raffle proceeds. The net raffle proceeds (after paying all other prizes, raffle and FMMA and/or Fieldstone Communities, Inc. expenses, and less those amounts going directly to the Kids Rock Free® program) will be divided evenly between the FMMA and the Grand Prize winner, less appropriate taxes.

The House, if available and selected, will be transferred directly to the Grand Prize winner upon completion of its construction and closing of escrow through an escrow company selected by Fieldstone Communities, Inc. The FMMA does not provide any guaranty or warranty, expressed or implied, in connection with the House. The FMMA accepts no liability or responsibility regarding the construction of the House. At the time of closing, all federal and state income taxes based on the value of the House award will be due from the Grand Prize winner. If the Grand Prize winner selects the cash alternate award instead of the House, or in the event less than 7,000 tickets are sold, appropriate and required federal taxes will be withheld by the FMMA in accordance with federal law, and the FMMA will remit the balance of the cash prize to the Grand Prize winner.

Who’s eligible, how much is a ticket, where can I get one, how will I be notified if I win?
Anyone 18 years of age or older may enter. Board members, capitol investors, employees and or the immeditate relatives of Fieldstone Group of Companies, FMMA, Vavrinek, Trine, Day & Co. LLP, First Fruit, and Newport Asset are not eligible to win any prizes. An affidavit of eligibility may be required from the prize winners. Further conditions of title transfer are available upon request to FMMA at 909-735-2440.

Tickets are $150 each. When you buy a ticket, $50 goes directly to FMMA to help assure the Kids Rock Free® program is supported and those funds will stay in the program! You can enter your name only or enter more names on the ticket to indicate the prize won is to be shared. Only the names provided on the ticket will be eligible to receive or take possession of the prizes. You may use the forum provided here on the website (just download it and send it in with your payment) or call 909-735-2440 with your Visa, Mastercard, or American Express card number and expiration date. Entry forms must include payment or credit card information to be eligible. You may buy as many available tickets as you wish. All sales transactions are final. No payments will be refunded. The FMMA reserves the right to reject any entry form in the event that a credit card transaction is rejected after three attempts. All defective or physically altered entry forms will be immediately disqualified by the FMMA. The FMMA will make a reasonable effort to notify any individual that submits such an entry form that the entry has been rejected prior to the Grand Prize drawing, but has no obligation to do so. The FMMA assumes no responsibility for lost, late, misdirected or non-delivered mail.

If any winner, including the Grand Prize winner, cannot be located by 5:00pm PDT, October 30, 2004, by the FMMA after making reasonable attempts to do so, or if the winner is deemed to be ineligible, such winner will be deemed to have forfeited their prize and another winner will not be selected for such prize.
